Terms of Service — Flitplay

1. What the Software is — and what it is not

Flitplay is a general-purpose media tool. It consists of:

a browser extension that detects magnet: and .torrent links, lets you paste or upload them, and plays video in a browser tab; and
a helper application that you install separately on your own computer, which runs a BitTorrent client and an HTTP server bound to loopback (127.0.0.1) on your machine, and hands video to the extension.

Flitplay does not provide, host, index, search, recommend, cache, or distribute any content. It ships with no catalogue, no search feature, no directory of torrent sites, and no preloaded links. It operates exclusively on material you supply: a link you click, a magnet URI you paste, or a .torrent file you choose from your own disk.

We are a neutral tool provider, comparable to a media player or a file-transfer utility. We have no knowledge of, control over, or ability to inspect, filter, approve, or block what you choose to process.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live if it is higher, and legally capable of entering into a binding contract. The software is not directed to children. If sanctions or export restrictions prohibit your use of software supplied from the country in which we are established, you may not use it.

3. Your content, your responsibility

This section is the core of these Terms. Please read it.

3.1 You are solely responsible

You are solely and exclusively responsible for every magnet URI, .torrent file, tracker, peer connection, download, upload, stream, and byte of data you cause the software to process, and for all consequences of doing so. That responsibility is yours alone. It is not shared with, delegated to, or assumed by us in any respect.

3.2 Your representations

Each time you use the software with a given item of content, you represent and warrant to us that:

(a) you own that content, hold a valid licence to it, it is in the public domain, it is distributed under a licence permitting your use (for example a Creative Commons or open-source licence), or your use is otherwise expressly permitted by applicable law;
(b) downloading, streaming, storing, and — where you enable seeding — uploading and redistributing that content is lawful for you, where you are, at that time;
(c) your use infringes no copyright, trademark, patent, trade secret, moral right, database right, publicity or privacy right, or other right of any person; and
(d) the content is not unlawful in itself, and in particular is not child sexual abuse material, terrorist material, non-consensual intimate imagery, malware, or material whose possession or transmission is criminal where you are.

If you cannot make every one of these representations for a given item, do not use the software with it.

3.3 Copyright — please read this

Downloading or sharing copyrighted films, television, music, software, books, or other works without the rightsholder's authorisation is unlawful in most countries. It may expose you to civil damages, statutory penalties, criminal liability, notices from your Internet service provider, throttling, disconnection, or account termination.

BitTorrent is a public, observable protocol. When you join a swarm, your IP address is disclosed to trackers, to DHT nodes, and to every other peer in that swarm — including peers operated by rightsholders, enforcement agencies, and commercial monitoring firms. Those firms routinely harvest these addresses and map them to subscribers. Flitplay offers no anonymity and makes no attempt to conceal your identity or IP address.

3.4 Seeding

Uploading (seeding) is disabled by default. If you enable it in Settings, you deliberately choose to redistribute the content in question to other people. Redistribution is legally distinct from downloading, and in most jurisdictions treated far more severely. You accept full responsibility for that choice and for every byte you transmit to third parties.

3.5 Prohibited uses

You must not use the software to:

infringe any intellectual-property right;
acquire, store, or distribute material that is criminal to possess or transmit, including child sexual abuse material;
circumvent a technological protection measure, paywall, geographic restriction, or access control;
distribute malware, or attack, overload, or disrupt any network, tracker, peer, or service;
evade a court order, injunction, or site-blocking measure;
violate any applicable law, sanctions programme, or export control; or
misrepresent the software as endorsing, authorising, or legitimising any particular content or source.

3.6 Our position on enforcement

We do not monitor your activity — we cannot, because none of it passes through us. We hold no logs of what you download. We therefore cannot remove content, disable a torrent, or act on a takedown notice concerning material you process: it is not on our systems and never was.

Nothing in this section limits your responsibility under §3.1. If a rightsholder or authority pursues an infringement carried out with the software, they will pursue you, and we will not defend or indemnify you.

4. The helper application and your computer

The helper is a separate native application that you download and install on your own machine, outside the browser's sandbox. By installing it you acknowledge:

(a) It runs a BitTorrent client with DHT, trackers, and peer exchange enabled, and opens outbound connections to arbitrary peers on the public Internet.
(b) It runs an HTTP server bound to 127.0.0.1 on an ephemeral port, protected by a random per-session bearer token, and refuses to serve if it cannot bind to loopback. It is not intended to be reachable from your local network or the Internet. If you deliberately expose it — by port forwarding, proxying, or tunnelling — you do so at your own risk.
(c) It may attempt automatic port mapping on your router (UPnP or NAT-PMP) as part of standard BitTorrent operation.
(d) It writes torrent payload data to a temporary directory created fresh per session and deleted on clean shutdown. An unclean shutdown — crash, power loss, force-quit — may leave that data on your disk. You are responsible for what remains on your own storage.
(e) It updates itself from our distribution origin, verifying a pinned SHA-256 digest and refusing downgrades. See §5.
(f) It may obtain FFmpeg at runtime. See §6.

You are responsible for the security, configuration, and lawful operation of your own computer and network, and for any household or organisational policies that apply to them.

5. Updates

The software may check for and install updates to the helper automatically, to deliver security fixes and compatibility changes. Updates are fetched only from our own distribution origin, are integrity-verified against a pinned SHA-256 hash, and are rejected if they would downgrade the installed version.

We may change, suspend, or discontinue any part of the software at any time without notice or liability. We do not guarantee that any version will continue to function, that the update origin will remain available, or that the software will remain compatible with any browser, operating system, or protocol.

6. Third-party components, FFmpeg, and codecs

The software incorporates third-party open-source components under their own licences, which prevail over these Terms as to those components. They include, without limitation, hls.js (Apache-2.0), Vidstack (MIT), github.com/anacrolix/torrent (MPL-2.0), the pion WebRTC stack (MIT), and the bundled IBM Plex Mono and Space Grotesk typefaces (SIL OFL).

FFmpeg is not bundled with the software. The helper uses FFmpeg already present on your system, or — where no system copy exists — downloads a pinned, hash-verified third-party static build. Those builds are distributed under the GNU General Public License, and their use may implicate patents covering certain audio and video codecs in some jurisdictions. Obtaining and using FFmpeg this way is an act you initiate on your own machine, and responsibility for licence and patent compliance where you are rests with you.

We do not control, endorse, or accept responsibility for third-party components, trackers, peers, torrent sites, or any external resource you reach using the software.

7. No privacy, anonymity, or security guarantee

The software is not a VPN, proxy, anonymiser, or privacy tool, and must not be relied on as one. It does not hide your IP address; BitTorrent by design discloses it to every participant in a swarm. Any expectation of anonymity while using the software is unfounded. If your circumstances require anonymity, this software is not suitable for you.

8. Intellectual property in the Software

The software, its source code, name, and branding remain the property of the operator of Flitplay and its licensors, except where separately licensed under an open-source licence. Subject to these Terms, we grant you a personal, revocable, non-exclusive, non-transferable licence to use the software for its intended purpose. You may not remove proprietary notices, or use our name or branding to imply endorsement.

9. No warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY.

To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and quiet enjoyment. We do not warrant that the software will be uninterrupted, error-free, secure, or free of harmful components; that it is lawful to use where you are or for your purpose; or that any content you obtain through it is accurate, safe, complete, or lawful.

You use the software entirely at your own risk, including the risk of data loss, disk exhaustion, malware inside downloaded files, exposure of your IP address, and legal claims arising from your use.

Some jurisdictions do not permit the exclusion of certain warranties. There, the exclusions above apply to the maximum extent permitted, and your mandatory statutory rights as a consumer are unaffected.

10. Limitation of liability

To the fullest extent permitted by applicable law:

(a) We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; nor for loss of profits, revenue, data, goodwill, or business, however caused, even if advised of the possibility.
(b) We are not liable for any claim, demand, penalty, fine, damages, settlement, litigation cost, ISP action, or criminal consequence arising from the content you choose to process, including copyright-infringement claims and enforcement notices.
(c) Our aggregate liability for all claims relating to the software shall not exceed the greater of the total amount you paid us for it in the preceding twelve months — which, the software being free of charge, is normally zero — and 50 euro.

Nothing here excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

11. Indemnification

You agree to defend, indemnify, and hold harmless the operator of Flitplay and any contributors and agents from and against any and all claims, demands, actions, proceedings, damages, losses, liabilities, penalties, fines, and expenses — including reasonable legal fees — arising out of or related to:

(a) content you downloaded, streamed, stored, uploaded, or shared using the software;
(b) your breach of these Terms or of any representation in §3.2;
(c) your violation of any law or of any third party's rights, including intellectual-property rights; or
(d) your configuration, exposure, or misuse of the helper.

We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, at your expense. You agree to cooperate with that defence and not to settle any such matter without our prior written consent. This section survives termination.

12. Termination

These Terms apply for as long as you use the software. You may terminate at any time by uninstalling the extension and the helper — the helper's uninstall command removes its native-messaging registration and its configuration directory.

We may terminate or suspend your licence immediately, without notice, if you breach these Terms. Sections 3, 6, 7, 9, 10, 11, 13, and 14 survive termination.

13. Governing law and disputes

These Terms are governed by the law of the country in which the publisher is established, without regard to conflict-of-law rules, and disputes may be brought before the courts competent for that place.

This does not deprive you of any protection you have as a consumer. If you are resident in the European Union, the United Kingdom, or any other jurisdiction granting non-waivable forum or consumer rights, you keep the right to rely on the mandatory law of your country of residence and to bring proceedings in its courts.

14. General

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the software.
Severability. If any provision is held unenforceable, it is limited or severed to the minimum extent necessary and the remainder stays in force.
No waiver. Failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them in connection with a transfer of the project or its assets.
Changes. We may amend these Terms. Material changes will be signalled by updating the date at the top of this page and, where practicable, by notice in the extension. Continued use after changes take effect is acceptance. If you disagree, uninstall the software.
Language. These Terms are drafted in English; any translation is for convenience only and the English text prevails.
